LOCAL ABORIGINAL LAND COUNCILS

LALC NAMES AND BOUNDARIES

Section 87 of the Aboriginal Land Rights Act allows for changes of names or boundaries of Local Aboriginal Land Councils. The process that must be followed is set out in Division 2, sections 19 - 22, of the Regulation.

LALCs may apply for:

  • a change of name
  • a change of boundaries
  • dissolution
  • amalgamation of two or more land councils (with the agreement of other land council/s)

Applications must be made in writing to the Registrar and should clearly specify:

  • the proposed changes to the name or boundaries, or the area of the land council that is to be dissolved
  • in the case of amalgamation, should recommend a name for the area of the proposed Local Aboriginal Land Council

In the case of a proposed change of name, the Registrar

  • writes to the NSWALC
  • receives and considers submissions from NSWALC and other parties
  • makes a recommendation to the Minister
  • advises the applicant of the Minister's decision

In the case of a proposed amalgamation, the Registrar

  • sends the application to the Minister and a copy to NSWALC
  • NSWALC makes a recommendation to the Minister
  • The Minister makes a decision and if the proposed amalgamation is approved, makes an order under section 87(1)(c) of the Aboriginal Land Rights Act
