MEMBERSHIP AND VOTING
VOTING AND NON-VOTING MEMBERS
The provisions concerning membership and voting rights are set out in the Aboriginal Land Rights Act in sections 53 to 56.
An Aboriginal person can be a member of more than one Local Aboriginal Land Council (LALC), but can only be a voting member of one LALC at any one time. If you are a member of more than one LALC you can nominate the LALC where you want to vote. You can only change your voting nomination once in any 12 month period.
To vote in elections for the LALC Board, members must have attended at least two meetings in the previous 12 months as a voting member.
LALC CEOs must record whether each member has voting rights in the LALC's membership roll.
HOW TO BECOME A VOTING MEMBER
To become a voting member of a LALC the Registrar must issue a notice stating that you are not a voting member of any other LALC. This notice is called a 'Section 54(3)(c) notice'.
- Fill out the 'Request For 54(3)(c) Notice' form [PDF]
- Give the form to the LALC where you want to become a voting member
- The LALC forwards the form to the Office of the Registrar
- If the person is not a voting member of any other LALC, the Registrar issues the Section 54(3)(c) notice to the LALC and to the member.
If you are a voting member of one LALC but wish to join and become a voting member of another land council, you must
- first be accepted as a non-voting member of the second land council
- then write to the Registrar to ask to change your voting area (see below How To Change Your Voting Area)
The Registrar can require someone who is a member of two or more LALCs to nominate where they wish to vote. If the member doesn't make a nomination their voting rights will be at the LALC in the area where they live.
HOW TO CHANGE YOUR VOTING AREA
If you are a member of more than one LALC and want to change your voting nomination, write to the Registrar using the form 'Request to Change Voting Area' [PDF]. Members can only change their nomination once in any 12 month period.

The Registrar will issue a notice (called a 'Section 56(5) notice') to the member and to the CEOs of the land councils where the person is a member to advise them of the change.
